الملخص

يقصد بأثر احكام محكمة قضاء الموظفين على القرار الإداري المقترن بمصادقة احكام القضاء العادي في العراق هو بيان مدى نفاذية احد الاحكام القضائية المتنازعة على القرار الإداري وتغليب احدهما على الأخر، و بالتأكيد ان لأحكام محاكم القضاء الاداري بنوعيها لها النفاذية على القرار الإداري من احكام محاكم القضاء العادي، وان اسباب هذه الأثر تعود إلى تنازع الاختصاص النوعي بين القضائين، العادي والاداري في الدول التي تأخذ بنظام القضاء المزدوج، وأن العراق اصبح من دول القضاء المزدوج بصدور قانون رقم (١٠٦) لسنة ١٩٨٩ التعديل الثاني لقانون مجلس شورى الدولة رقم ٦٥ لسنة ١٩٧٩، وتبنيه النظام الاتحادي، بصدور دستور ٢٠٠٥، ويتناول بحثنا احد حلول ونتائج أثار هذا التنازع في الاحكام الصادرة من القضائين، والأسباب التي احدثته من اختلاط وعدم استقلال ووضوح الاختصاص النوعي للمحاكم في العراق، وقد وفق المشرع العراقي في تحديد الجهات المختصة في حلحلة هذا الأستشكال والتنازع وتحديد الجهة المختصة بحلهِ، حيث اناط مهمة الفصل في التنازع بين القضاء العادي والإداري إلى هيئة تسمى بــ (هيئة تعين المرجع) ومنح المحكمة الادارية العليا اختصاص الفصل في النزاع بين محكمة القضاء الاداري ومحكمة قضاء الموظفين.
