الملخص

يتناول البحث دراسة المصنفات الفكرية (الأدبية، والفنية، والعلمية) كإحدى المخرجات المستنبطة عن طريق الذكاء الاصطناعي من خلال التغذية بالبيانات والمعلومات المشتقة من مصادر أخرى، حيث تُعد المصنفات الأدبية من أهم مخرجات تطبيقات الذكاء الاصطناعي. ويثير البحث في ثناياه تساؤلات متعلقة بنوعيه المصنف ودرجة الابتكار فيها وتحديد مؤلفيها وما قد يشكله المصنف المستنبط ذاته من تعدي على المصنفات الأخرى، مميزاً بذلك المصنفات المستنبطة التي فيها قدر من التدخل البشري عن المصنفات المستنبطة المستقلة، ومبيناً في الوقت ذاته فلسفة حماية المصنفات الأدبية من خلال قواعد حقوق الـتأليف في الموازنة بين مصلحة المجتمع في الوصول إلى المعرفة ومنح الحقوق الحصرية للمؤلفين بما يمكنهم ويشجعهم على المزيد من الابتكار، ومدى توافق أسس الحماية مع مصنفات الذكاء الاصطناعي.
