انتهاء عقد التخزين السحابي: دراسة قانونية مقارنة

الملخص

إن عقد التخزين السحابي من عقود الحوسبة السحابية، ويندرج ضمن عقود الإيواء السحابي، ويتميز بخصوصية تخزين البيانات على الإنترنت يتم من بموجبه توفير الخوادم والبنية التحتية من قبل مزود خدمة سحابية. ويتولى مقدم الخدمة إدارة وصيانة هذه البنية التحتية، ويضمن للمستفيد إمكانية الوصول إلى بياناته في أي وقت ومن أي مكان.


وعقد التخزين السحابي حاله حال جميع العقود المستمرة ينتهي نهاية طبيعية بانتهاء مدته العقدية أو ينتهي بالتفاسخ بإرادة طرفيه أو الفسخ بأمر المحكمة أو الانفساخ بقوة القانون. ولضمان خصوصية البيانات والمعلومات الخاصة بالمستخدم وهو الطرف الثاني في عقد التخزين السحابي فلا بد من تضمين العقد شرطاً بحذف كافة البيانات المخزنة والتعهد بعدم استخدامها أو تسريبها من قبل مقدم الخدمة بعد انتهاء العقد،  ولضمان حقوق طرفي العقد وخصوصا الطرف الضعيف وهو عادة ما يكون المستفيد فقد شرعت العديد من القوانين واللوائح، وندعو المشرع العراقي إلى تنظيم هذا النوع من العقود كما فعلت التشريعات القانونية.
