فاعلية هيئة النزاهة الاتحادية في ظل ما يعترضها من معوقات

الملخص

تُعد هيئة النزاهة الاتحادية واحدة من أهم الهيئات الرقابية التي أُسست بموجب الأمر رقم 55 لسنة 2004 (الملغى حالياً) والقانون التنظيمي الملحق به. وقد أُعيد التأكيد على وجودها لاحقاً بموجب دستور جمهورية العراق النافذ لعام 2005، الذي منحها مجموعة من الصلاحيات الرامية إلى تمكينها من أداء مهامها في مكافحة الفساد الإداري والمالي، وتعزيز ثقافة النزاهة والاستقامة والشفافية والمساءلة، وذلك في ظل مبادئ الحياد والإخلاص والأمانة. ورغم التحديات والصعوبات والعقبات العديدة التي قد تعيق عملها، فقد نجحت الهيئة -من خلال آلياتها القانونية والتنظيمية- في تحقيق جملة من الإنجازات في مجال مكافحة الفساد الإداري والمالي. ومن ثم، بات من الضروري دراسة طبيعة هيئة النزاهة الاتحادية وإطارها القانوني، وتحديد العقبات التي تحول دون تحقيق أهدافها وأداء مهامها، وتسليط الضوء على أبرز إنجازاتها في ظل تلك القيود.
