الرهن التأميني للمنقول (نحو تنظيم قانوني جديد للرهن التأميني في القانون العراقي)

الملخص

تتيح أحكام التصرف في الأموال المنقولة في القانون العراقي إمكانية إعادة النظر في النصوص المنظمة لرهن المنقول، وذلك بالنظر إلى عدم ملاءمة أحكام الرهن الحيازي لحكم كل المنقولات، والتي تتطلب في العادة القبض لانعقاده.


ويثير التطبيق العملي لرهن بعض المنقولات بسبب طبيعتها الخاصة إشكالات عدة. ولأجل مواءمة التشريع العراقي للتطورات الحاصلة في مجال التأمينات العينية ومواكبة المتطلبات الاقتصادية والاجتماعية، ينبغي على المشرع العراقي التدخل لتعديل القوانين المنظمة لأحكام التأمينات العينية بحيث يمكن رهن المنقول تأمينياً إلى جانب رهنه حيازياً، وإيجاد آلية مناسبة لحماية الدائن المرتهن في هذه الحالة.


وبناءً عليه، فإن هذه الدراسة محاولة لتنظيم أحكام رهن المنقول بحيث تواكب التطورات الحاصلة على المستويين الدولي والمحلي، وبما يتماشى مع المستجدات التي طرأت في مجال رهن المنقول. وقد قدمت الدراسة بعض المقترحات في سياق ذات صلة بموضوعها.
