الملخص
تعتبر مسألة حماية وتحسين البيئة من ابرز المسائل التي تهم حياة الانسان بسبب تعلقها بالنظام العام ومساسها بعنصر الصحة العامة للأفراد ، مما يحتم على الادارة قيامها باتخاذ الاجراءات اللازمة لحماية البيئة والحفاظ على الانشطة الثقافية والتاريخية لاتصالها بموضوع البيئة ، لذلك اتجه التشريعات الخاصة بحماية وتحسين البيئة نحو السماح للأجهزة الادارية باتخاذ التدابير اللازمة لوقاية العناصر البيئية من ظاهرة التلوث البيئي بالإضافة الى تمكين الجهات الادارية فرض الجزاءات اللازمة في حال الاخلال بالنظام البيئي من جراء الانشطة الانسانية وفرض التعويض عن الاضرار البيئية .
