الملخص

إن التشريعات الوظيفية - من حيث القاعدة العامة - درجت على حصر العقوبات الانضباطية, على العكس من المخالفات التي لم تحدد على سبيل الحصر بسبب طبيعتها الخاصة لتعذر  تحديدها تشريعياً, إلا أن تلك التشريعات لم تربط كل مخالفة بالعقوبة الانضباطية المقررة لها ؛ مما ترتب على ذلك نتيجة منطقية مفادها منح الإدارة سلطة تقديرية في تقدير العقوبة الانضباطية التي ترى أنها تتناسب مع جسامة المخالفة المرتكبة, إلا أن تلك التشريعات قد خرجت عن القاعدة العامة في بعض الانظمة الوظيفية فحددت عقوبة محددة بذاتها لمخالفة انضباطية معينة مما جعل سلطة الإدارة مقيدة بفرض تلك العقوبات, وإن السلطة التقديرية للإدارة في تقدير العقوبة الانضباطية ليست سلطة مطلقة, وإنما ترد عليها قيود يجب على الإدارة مراعاتها عند تقديرها للعقوبة, ومن هذه القيود مراعاة تناسب العقوبة مع المخالفة الانضباطية, الذي يعتبر أداة للتوازن بين حق الإدارة في تقدير العقوبة وعدم معاقبة الموظف بعقوبة لا تتناسب مع المخالفة المرتكبة.
