الملخص

    دأب المشرع العراقي اشتراطه للشكلية في أهم التصرفات القانونية، ومنها بيع المركبات والعقارات والمكائن ، وغني عن البيان ما للمركبات من أهمية في حياة الناس في نقل الأشخاص والبضائع، وهذا الشكلية التي فرضه المشرع العراقي كركن لانعقاد بيع المركبات ليست طارئة على قانون المرور العراقي النافذ رقم (8) لسنة 2019، بل تمتد جذورها إلى قانون المرور رقم (48) لسنة 1971، التي أوجبت لانعقاد بيع المركبات استيفاء الشكلية التي فرضه القانون بتسجيل عقد البيع في دائرة المرور المختصة بعدّه عقداً شكلياً، فضلاً عن أركان العقد الأخرى من رضا ومحل وسبب ويرتب على تخلفه بطلان العقد وعدّه كأن لم يكن. وهذه الشكلية في العقود لها أهميتها، وبلغت هذه الأهمية أقصاها عندما كان ركن الشكلية الأصل في إبرام العقود، ثم صارت الشكلية استثناء وليس أصل ولا زالت الى وقتنا الحالي استثناء كما هو الحال في عقد بيع المركبات في التشريع العراقي وقد تواصلت تطورات الشكلية عبر العصور.
