discretionary authority of the administration in assessing disciplinary sanction (Comparative Study)

Abstract

The employment legislations –from the general base- including the disciplinal penalties, in contrary of the violation which didn’t specified because of their special nature, can not specify them legislatorial, but those legislations didn’t link each violation with the disciplinal penalty which suit for it, which followed that a logical result that says give the administration estimating authority in estimate the disciplinal penalty which see it fit with the committed violation, but those legislations maybe penetrate the general base in some employment systems, then specify a certain penalty for disciplinal violation which led the administration authority limit in impose those penalties, and the estimating authority of the administration in estimate the disciplinal penalty not absolute, but there are some limits on it, from those limits considering penalty suite with the disciplinal violation which regard a tool for balance between the administration right in penalty estimation and not punishing the employee with penalty don’t suit with the committed violation.
