Combining mortgage and guarantee in securing the same debt - an analytical study in Iraqi civil law

This research addresses combining mortgage and suretyship for a single debt, given the legal issues regarding execution order, surety liability, and the impact of mortgage discharge on the suretyship obligation. The problem involves determining the legal effect of combining real and personal securities and the creditor's obligation to follow a specific order under the Iraqi Civil Code. Adopting an analytical approach, the research examines legal texts, jurisprudential opinions, and judicial precedents to clarify their legal nature and the basis for combining them. It also addresses the effects, notably priority of execution on mortgaged property, the restriction on pursuing the surety unless the debtor's assets are insufficient, and the impact of mortgage discharge on the surety’s commitment. The study concludes that the Iraqi legislator permits combining both securities while imposing a legal order of execution to balance interests. It recommends amending Articles (1299) and (1308/II) of the Civil Code to enhance creditor protection, safeguard the legal status of the debtor and surety, and achieve stability in credit transactions.
