Employing artificial intelligence technologies in arbitration processes: a study of Palestinian arbitration law in comparison with the uncitral model law on international commercial arbitration and the rules for expedited arbitration

Abstract

This research aims to examine the extent to which artificial intelligence (AI) technologies may be integrated into the arbitral process as an alternative means of dispute resolution, with a particular focus on the Palestinian legal framework and its comparison with international rules, especially the UNCITRAL Expedited Arbitration Rules of 2021. It further seeks to analyze the legal challenges that may arise from reliance on intelligent systems in rendering arbitral decisions, particularly in cases involving errors or data manipulation.


The study adopts a descriptive, analytical, and comparative methodology, through the examination of national and international legal texts relevant to arbitration and the use of artificial intelligence, and by comparing the Palestinian Arbitration Law No. (3) of 2000 with the UNCITRAL Model Law and its Expedited Rules. The research also draws upon recent academic studies in the fields of electronic arbitration and artificial intelligence.


The findings indicate that AI technologies possess significant potential to enhance the efficiency of the arbitral process by ensuring speed, confidentiality, cost reduction, and improved decision accuracy. However, their use raises legal issues concerning the legitimacy of decisions rendered by an “automated arbitrator,” and the extent of party liability for technical errors or data tampering.


The study concludes that Palestinian legislation remains in need of clear updates to keep pace with digital transformations and to adopt a structured legal framework governing smart arbitration. It ultimately finds that the integration of artificial intelligence into arbitration constitutes an advanced step toward the development of digital justice in Palestine and worldwide, yet it necessitates a comprehensive legislative framework that balances technological progress with the requirements of justice and the rule of law, ensuring the protection of parties’ rights and the independence of arbitral decisions.
